Treating Minors

Policy on Medical Care for Patients Aged 16-17

Policy Statement

Patients aged 16–17 are permitted to be seen in the office for routine clinic visits without the requirement of a guardian’s presence, provided they can independently make healthcare decisions. However, for any endoscopic or similar invasive procedure, additional consent from the legal guardian is required prior to scheduling.

Office Visit Appointments

  • Patients aged 16–17 may schedule and attend routine clinic visits without the need for a legal guardian to be present.
  • They may sign their own HIPAA authorization form for the release of their medical records, as allowed under South Carolina law.
  • The patient’s parent or legal guardian must make prior arrangements to sign the necessary financial documents and/or consents prior to the appointment to file insurance.

Procedure and Additional Testing

  • For any endoscopic procedure (e.g., colonoscopy, upper endoscopy) or other invasive procedure:
    • The legal guardian must provide consent before scheduling. The minor patient may not independently provide consent.
    • The ordering provider must obtain verbal consent from the guardian, and this conversation must be documented in the patient’s chart.
  • Our endoscopy centers only perform procedures on patients 18 and older.  Procedures for individuals under 18 will only be performed in a hospital setting. The hospital will also obtain consent to treat prior to the procedure.

Note: South Carolina law allows minors aged 16 or older to consent to most health services, except for operations, which may only be performed if deemed essential by a physician (and a consulting physician, if available).

Financial Responsibility

  • The legal guardian must sign the financial consent form for insurance filing.
  • This consent form may be signed in person or sent electronically.
  • The guardian will be held financially responsible for all treatments, visits, and related charges.
